Regulations and Permits for Outdoor Projects

Navigating the legal landscape in Marbella is essential for any home improvement project. In Nueva Andalucía, urban planning is governed by the Ayuntamiento de Marbella. It is crucial to understand that the urban planning situation (PGOU) underwent a major shift after the Spanish Supreme Court annulled the 2010 PGOU in 2015. Consequently, the municipality reverted largely to the 1986 PGOU with subsequent adaptations. While a new PGOM (Plan General de Ordenación Municipal) is currently in the drafting process to modernise these rules, we must currently verify the specific classification of every plot individually to ensure compliance.

For most outdoor projects, we distinguish between two types of procedures. An "Obra Menor" (minor works) typically involves a "Declaración Responsable" or a simplified licence. This is generally sufficient for installing awnings, pergolas, artificial grass, or non-structural glass curtains. Any shading systems we install must comply with the UNE-EN 13561 standard for wind resistance and safety. However, a swimming pool is considered an "Obra Mayor" (major works), which requires a full municipal licence, a technical project signed by an architect, and the payment of specific building taxes (ICIO).
