Regulations and Permits for Landscaping in Nueva Andalucía

Navigating the legal landscape of Marbella is essential for any outdoor project. In Nueva Andalucía, the "competencia urbanística" falls under the Ayuntamiento de Marbella. It is crucial to understand that the local planning situation is unique: following the 2015 Supreme Court annulment of the PGOU-2010, the municipality reverted largely to the PGOU-1986 along with subsequent adaptations. Currently, a new PGOM (Plan General de Ordenación Municipal) is in the process of being approved. Because of this transition, we must verify the specific classification of your plot ("parcela a parcela") before starting significant works.

For most landscaping projects, we distinguish between "obra menor" and "obra mayor." Minor works, such as installing artificial grass, glass curtains (non-structural), awnings, or pergolas, usually require a "declaración responsable" or a simplified license.
