Navigating the legal landscape for outdoor projects in Marbella requires expert local knowledge due to a complex planning history. It is critical to understand that the 2010 PGOU (General Urban Planning Plan) was annulled by the Spanish Supreme Court in 2015, which effectively restored the 1986 PGOU as the governing document for the municipality. While a new PGOM received a favourable report from the Junta de Andalucía in February 2024 and awaits final plenary approval, the planning status of approximately 18,000 properties remains legally uncertain. This means every project must be meticulously verified against the 1986 plan and any specific protected-zone overlays, such as those found in Las Chapas or the heights of Sierra Blanca.
